Your 2025 Guide to Employment Authorization Documents (EAD) 

What is an Employment Authorization Document (EAD)? 

An Employment Authorization Document, often called a work permit, is issued by USCIS and gives certain immigrants the legal right to work in the United States. You may qualify for an initial EAD if your immigration status or pending application allows it. 

Common Categories Eligible for EAD 

  • Pending asylum applicants. 

  • Pending adjustment of status applicants. 

  • TPS (Temporary Protected Status) holders. 

  • DACA recipients. 

  • Certain spouses of visa holders. 

  • VAWA and U visa applicants. 

Benefits of an EAD 

  • Legal proof to work for any U.S. employer. 

  • Valid for one or two years depending on your category. 

  • Often renewable while your underlying status is valid or your application is pending. 

The Process 

  1. File Form I-765 with supporting documents. 

  1. Provide proof of eligibility (pending case receipt, status approval, etc.). 

  1. Submit fee or fee waiver request. 

  1. Receive approval notice and card by mail. 

Renewal Tips 

  • File your renewal 180 days before your current card expires. 

  • Certain categories qualify for an automatic extension if you apply on time. 

 

Policy Update – 2025 

⚠️ Policy Update: 
Under the current administration, there is talk of shortening automatic extensions from 540 days to 180 days and requiring faster biometrics for initial EADs. This could cause gaps in work authorization if you apply late.
